Before 1839, the custody of children were automatically given to a living father. Through the Court of Chancery, given by the Custody of Infants Act (1839), it was granted that the custody of children under seven will be given to the mother. This continued on until 1873, which was also the year that the maternal right to custody was extended to sixteen years of age.
