Henry is convicted of multiple break-and-enters believed to be sexually motivated, as well as an attempted rape.
Henry is forced into police line-up and later arrested/charged for the suspicion of committing a series of rapes
Appealed and later convicted of 3 rapes, 2 attempted rapes, and 5 indecent assaults
During Investigations of sexual assault cases, the Vancouver police found another suspect who was later proved to have conducted a series of rapes during the period in which Henry was convicted. Due to the similarity of the cases, the Vancouver police decided to look back at the evidence in Henry’s conviction.
The Vancouver police formally recommended the reopening of Henry’s case in which the Crown agreed.
Ivan Henry’s case was reviewed and the British Columbia Court of Appeal overturned Henry’s convictions.
Chief Justice Beverley McLachlin asked the Supreme Court of Canada judges whether under the constitution the court could compensate for prosecutorial misconduct committed by Crown
