Description:
A court case that brought about the passage of the 11th Amendment. Alexander Chisholm, a resident of South Carolina, sued the state of Georgia over payments made to the state during the War for Independence. Georgia refused to show, claiming that it could not be sued without its consent due to its position as a state. However, the Supreme Court ruled 3-1 that federal courts had the right to hear cases between citizens and states. However, Congress disliked the ruling and facilitated the passage of the 11th Amdenment, which overturned the verdict. Chislm v. Georgia is often considered the first landmark Supreme Court case.
