Description:

Medical marijuana is legal in 19 states, and in 9 of those states recreational marijuana is "legal." It is only "legal," because the state laws and federal laws about recreational marijuana go against each other. In this situation, federal laws are the most important and have priority according to the Constitution, however that isn't what happens. Citizens of a particular state are allowed to follow state laws even if they contradict federal law, although the federal government can enforce their own laws at any time. An example of complicated state vs federal law is the U.S.A. v Gerald and Jeremy Duval case.
