1980s-1990s: In the 1980s and 1990s, U.S. immigration policies began merging
immigration and criminal law. In 1986, the Immigration Reform and Control Act required
the government to deport non-citizens conveyed of deportable crimes (like drug trafficking and serious felonies). In 1996, the Antiterrorism and Effective Death Penalty
Act and the Illegal Immigration Reform and Immigrant Responsibility Act expanded the
categories of deportable crimes and increased the use of prisons and jails to identify
undocumented immigrants for deportation.
