Elliot v. Leavitt (jun 2, 1970 – sep 24, 1970)
Description:
A man named Dorothy D. Elliot was driving while drunk and officer Jason Leavitt and Wayne Cheney stopped him. While stopping Elliot they found out that he was drunk and he had a concealed weapon on him. Elliot reached for the gun and held it in his hands causing Leavitt and Wayne to shoot Elliot. While in District Court the question was if the officers used excessive force. The District Court ruled in favor of Elliot and agreed that law enforcement used excessive force when dealing with Elliot. The U.S. Supreme Court overturned this rule and ruled in favor of the officers Leavitt and Wayne.
