Amber Heard had issued a Subpoena Duces Tecum to The Weinstein Company asking question about Johnny Depp during the making of The Libertine in 2004. At this time Weinstein’s first trial was taking place in the Manhattan Supreme Court and anyone associated with him was being tarred with the same brush - hence Johnny Depp also requesting a Protective Order.

It is also worthy of note that Roberta Kaplan had previously represented Harvey Weinstein in a different matter but had links with his company nevertheless.

As the subpoena was to be served to the New York based Weinstein Company the petition to quash was filed in the New York County Court.
