Johnny Depp
LETTER
Description:
On September 15, 2015 Marty Singer wrote Nicola Six on behalf of Heard's husband,
Johnny Depp. The letter claimed that because TIFF had put Depp's name up on its website for the film, as one of the actors appearing in the film, and Depp's contract with Nicola Six required that his name not be used to promote the film, that Nicola Six must have been trying to use his name to promote the Movie: "Your clients' conduct exposes them to damages in excess of $10,000,000." Nicola Six responded that it had never used Depp's name to promote the Movie. Then Singer argued that Depp's contract required Nicola Six to require that licensees not use Depp's name, and
because TIFF used Depp's name, it must have been Nicola Six's fault. Singer failed to acknowledge that Heard's own representatives had informed TIFF that Depp appeared in the Movie. In any event,TIFF immediately took down Depp's name at Nicola Six's request.
