Castaneda v. Pickard was a case tried in the United States District Court for the Southern District of Texas in 1978. The Raymondville Independent School District had a suite filed against them in Texas by Roy Castaneda, the father of two Mexican-American kids. It was claimed by Roy Castaneda that discrimination was placed against the Castaneda children because of their ethnicity. The father claimed that discriminated against his children by way of segregated in the classroom and failed to establish sufficient bilingual education. In June 1978; August 17, 1978 the court ruled in the favor of the defendant based on its determination that
the policies and practices of RISD did not violate any constitutional or statutory rights in the plaintiff class. At this point an appeal was filed in 1981. The United States Court of Appeals for the Fifth Circuit ruled in the way for the Castaneda's and established a three-part assessment for determining how bilingual education programs would be responsible for meeting the requirements of the Equal Educational Opportunities Act of 1974. This case has a strong influence in the English language learner education because the program should be based on sound educational theory. Segregation should not exist in a EL program and each learner no matter what race they may be, should all be treated equally.
