Description:
South Carolina argued that the Voting Rights Act violated states’ rights but the Warren Court rejected this.
They ruled that given the history of systematic resistance to the Fifteenth Amendment for over a century, lawmakers could constitutionally “shift the burden of proof from the victims of disenfranchisement to the perpetrators of the evil”.
Evidence of a favourable Supreme Court enhancing the movement.
