Samuel J. Tilden, known for prosecuting "Boss" Tweed vs. compromise candidate Hayes. 3 states were disputed because of irregular voter return, one democratic, one republican. The constitution only stated that electoral returns have to be sent to congress but did not specify who should count the votes. This election led to the Compromise of 1877 and the Electoral Count Act.

The Electoral Count Act, passed in 1877, which set up an electoral commission consisting of 15 men selected from senate, house, and supreme court. In February 1877, the commission voted 8 to 7 to accept republican returns for Florida, which helped Hayes win the presidency and settle disputes.
