The Sherman Antitrust Act was the first federal antitrust law, which authorized federal action against any “combination in the form of trusts or otherwise, conspiracy in restraint of trade”. For years, there was a lack of specificity in the act’s wording which led the courts struggle on the agreement of the words “trust”, “combinations”, and “restraint of trade”.
