Benjamin Gitlow was publishing The Revolutionary Age, a communist newspaper that advocated overthrowing the government. He was arrested for criminal anarchy. He argued that his right to freedom of speech was violated. The supreme court decide that the was no clear and present danger. This out come lead to an increase in frredom of speech rights.
