Quianna Vigil , wife of Jamie Ceballo, called the police reporting that her husband was in the driveway acting crazy, drunk, and mostly on drugs-- she requested that police remove Ceballos so she could return with their young daughter. William Husk, within minutes of arrival, shot and killed Ceballos. Ceballos's estate started a suit against Husk with the claim of excessive force and against the city for failing to train officers in how to handle individuals who are emotionally distraught.

"We should reverse the district court’s denial of summary judgment to Officer Husk on the issue of qualified immunity. The district court erroneously concluded that Officer Husk’s conduct violated a clearly established constitutional right. Because the majority upholds this ruling, I respectfully dissent from Part II(A) of the majority opinion. "
