Description:

Argued March 4th 2014 and Decided May 277th, 2015 Plumhoff v. Richard took place after Donald Rickard led a high speed police chase, hitting an officers car and almost hitting an officer. Officers ended up firing, and killing, Rickard with 12 gun shots. Rickards daughter filed suit claiming excessive force in filing the in Fourth and Fourteenth amendment. the Sixth Circuit held that the officers’ conduct violated the Fourth Amendment. It affirmed the District Court’s order, suggesting that it agreed that the officers violated clearly established law.
