On August 12th, 2016, Officers were called to the house of the ex-wife of Dominic Rollice, she state Rollice was drunk and refusing to leave her garage, which he entered without her permission. 2 officers arrived to the scene, officers Vick and Girdner, who requested to pat Rollice down. Soon Rollice began backing further into the garage and a third officer, Officer Reed, arrived. Once Rollice was cornered in the back of the garage, he picked up a hammer and held it above his head, refusing to drop it. He was then shot by police and killed. (Graphic video linked, watch with discretion). Rollice's estate filed a suit stating the officers used excessive force, the federal district court ruled in favor of the officers. The estate did appeal which overturned the lower court's decision. The court state that a reasonable jury could find the officers created a lethal situation by “by driving Dominic into the garage and cornering him with his tools in reach” and their “reckless conduct unreasonably created the situation that ended Dominic’s life”. This created a new president over Graham V. Connor, as beforehand the police had been considered innocent in the use of force. This was the downfall of Graham v.
