Description:
Superior Court Judge Kathleen Parker declared the mistrial after jury members reported they were hopelessly deadlocked 9-3 in favor of acquittal after almost seven weeks of deliberations.
The same jury last month acquitted the younger Marino on three counts of kidnapping and conspiracy, and acquitted Thomas Napolitano, 56, a Pittsburg, Calif., grape, and walnut grower, of charges he took part in the
killing.
The senior Marino, 56, was convicted of the murder of the younger Catelli and the attempted murder of the
older Catelli. Joseph Piazza, 47, was also convicted of second degree murder for the Catelli slaying. They appealed their convictions and have not yet been sentenced.
