Description:

Marbury V. Madison was a court case presented to the supreme court regarding the judicial view on the federal courts power regarding the Constitution. Whether or not the federal courts could declare the executive or legislative acts unconstitutional was up for debate. James Madison was sued by William Marbury to hold onto his commission. The supreme court decided that Marbury could in fact take office as the justice of peace, contradicting Jefferson's attempt to keep him out.
