Surprisingly 300 men agreed. The next morning before the sun came up James Neil distracted the Mexican army with gun fire, while Milam and Francis W. Johnson led two groups on surprise attack on Veramendi and Garza houses. That night and the next morning they destroyed a lot of buildings, and dug trenches. On the seventh day of December they captured another house, but Millam got shot that day. Cos ordered troops to attack the base of the Texan army, but found it to hard. When he gave up he ran away. Cos asked for a surrender terms on December 9. Burleson agreed.
