Description:

During the “Red Scare,” a time when communism in the United States was an extreme threat, Benjamin Gitlow was arrested for partaking in in “left-wing manifesto” or extreme avocation. This case was extremely controversial, as it was dealing with freedom of speech and the standards of the Clear and Present Danger Test were not upheld. Benjamin Gitlow’s conviction was proved constitutional within court. The Court, after the dismissal of the case, restricted states from persecuting people due to freedom of speech.
