nov 29, 1981 - Castañeda v. Pickard

Description:

This was a case against RISD in Texas by Mr. Castañeda who was the father of two Mexican- American children who he believed the district discriminated on the basis of their ethnicity. On August 17, 1978, a judge ruled that there was no discrimination done by the district. However, on 1981, an appeled was held and Mr. Castañeda won the case this time. From there on, 3 criterias were established for a program that serves LEPS. First, it must be based on "a sound educaional theory". Second, it must be "implemented effectively", with adequate resources and personnel. Third, after a trial period, ir must be evaluated as effective in overcoming language barriers/handicaps.
