- Questioned constitutionality of "separate but equal" legislation in the South, specifically in Louisiana- Plessy, a black & white man, purchased a train ticket for a white coach in 1892
- Denied and appealed to Supreme Court of Louisiana
- Later took the case to the U.S. Supreme Court and lost on May 18, 1896
- Whiteness, for the first time, was deemed a precious "property"
