Description:

In the Mills case, Peter Mills, a student with behavioral issues, filed against the District of Columbia after being unable to attend schools. The school district claimed that their exclusion of Peter was constitutional because his behavioral issues would be too expensive to address and would place “an undue burden” on the district (Crane, 2015). The Court ruled against the school declaring that “no child eligible for a publicly supported education could be denied such education without an equal alternative tailored to the child’s needs” (Li, 2012). This case lead to further litigation on the basis that no student can be excluded from receiving an education, and it ultimately lead to the passage of important federal policies such as the Education for All Handicapped Children Act of 1974.
