Asadi v. G.E. Energy
(Court of Appeals)
Description:
2006-2010: Asadi served as Iraq Country Executive in Amman, Jordan. 2010: Asadi reported an alleged conduct violation to his supervisor; he soon received a negative review; GE Energy fired him; Asadi filed a complaint internally.
GE Energy moved to dismiss Asadi’s complaint under Rule 12(b)(6) on the basis that it failed to state a claim because, inter alia,
(1) Asadi does not qualify as a “whistleblower” under the whistleblower-protection provision, and
(2) the whistleblower-protection provision does not apply extraterritorially.
The district court agreed with GE Energy’s reasons for dismissing the complaint.
