Description:

originally intended by Johnson to protect the individual from discrimination, Nixon expanded the idea to apply to privileges on certain groups. In Bakke, a white applicant who had higher entrance exam scores was rejected while a black applicant with lower entrance exam scores was accepted (to CA med. school). The white student, Allan Bakke claimed "reverse discrimination". The Supreme Court agreed, saying that educational institutions could not give preference to minorities solely on the basis of race, ethnicity, or gender, rather it could be taken into account. This ended up causing Universities lots of headaches, since the Courts rulings on affirmative action seemed contradictory.
