This case addressed the legality of California's Proposition 8, which banned same-sex marriage in California. The California Supreme Court ruled in 2008 to legalize same-sex marriage state-wide, but voters amended it with Proposition 8 later the same year. Two queer couples - lesbians Perry and Stier and gay men Katami and Zarrillo - sued after Prop. 8 passed, claiming it violated the the 14th Amendment for due process and equal protection. The federal district court struck down Proposition 8, but Prop. 8 supporter Hollingsworth challenged the ruling in the supreme court.

The case was not decided, but rather dismissed in a 5-4 decision on procedural grounds as Hollingsworth did not have standing to appeal. The Court ruled an individual who brings forth an appeal must prove personal injury, which Hollingsworth was unable to do. As the case was dismissed, it did not set a nationwide precedent for same-sex marriage.
