The Every Student Succeeds Act (ESSA) was a re-authorization of the Elementary and Secondary Education Act and a re-work of the No Child Left Behind Act. The intent of this law was to "provide all children significant opportunity to receive a fair, equitable, and high-quality education, and to close educational achievement gaps." ESSA allows the states more control over their education than NCLB previously did.

Title III of ESSA is focused on ELL instruction and uses English proficiency as a metric for school quality. It also creates some new criteria on identifying, categorizing and intervening with ELL students to provide them the education they deserve. More funding was made available for ELL learning as well, and testing requirements were clarified.
