This law established federal funding for schools to teach English to non-native speakers. The law was originally proposed by Senator Ralph Yarborough (TX), who saw a need for more funding in Texas schools to help immigrants from Mexico to learn English. President Lyndon B. Johnson signed the BEA into law in 1968.

The law provides funding for helping to create, run and maintain English-language learning programs, such as staffing them and providing teacher training. Originally, the BEA focused only on lower-income communities, but it was revised multiple times to open funding to many more schools and help provide ELL education to more students.
