Castaneda v Pickard, 1981

The court ruled that schools must take appropriate action to overcome language barriers and laid out a three pronged definition of “appropriate action.

1. The school must pursue a program based on an educational theory recognized as sound.
2. The school must implement the program with appropriate instruction, resources, and personnel.
3. The school must evaluate the program and take action if the program does not produce results.

The influence of this ruling can still be found in today’s policies and standards.

For example, the WIDA standards emphasize learning across the curriculum.

Additionally, the Indiana Department of Education has provided the following document for schools as a tool to evaluate their EL programs and services, based upon the requirements laid out in the Castaneda v. Pickard ruling.
