The Separate Car Act of Louisiana required separate railway cars for blacks and whites. Plessy, who was mixed race, sat in a whites only car. He refused to leave the car when told, and was arrested.

This decision legitimized the reestablishment of racial segregation that had ended after the Reconstruction era, as well as legitimized the establishment of new segregation laws.
