It is further alleged that a side agreement (undertaking letter) exists to the document also. The date is known as it appeared in the LNS commission findings.

As the undertaking letter, if accurate, indemnifies Newco from disciplinary action relating to the EBT issues and the LNS Commission was to be appointed within days, it raises the question of how any significant penalty in the event of serious punitative outocomes of the LNS enquiry could have been upheld and helps explain why Charles Green was adamant the SPL had no authority to conduct such an enquiry.
