Context: During the arguing of the case, the United States was still participating in the Vietnam War. Tension was palpable and protests to end the war kept sprouting across the nation. Students in Des Moines chose to wear black armbands to support the possibility of a truce in the war. The officials of a school decided to ban the wearing of black armbands, and students refused to remove them. The students were sent home, and in turn, their parents sued the school for restricting the student's freedom of expression.

Impact: It was ruled that the black armbands was symbolic speech that was not interfering with school activities. This case established that the freedom of speech is not unlimited within schools. If the speech would interfere with school activities or students learning, then it would be restricted.
