13 gen 1958 anni - One, Inc. V. Olesen (1958)
Descrizione:
This case involved One Magazine, the first national LGBTQIA+ magazine that advocated for acceptance of homosexuality. One Magazine contained discussions of homosexuality, which where seized by the U.S. Post Office under claims they were obscene under federal law and violated postal regulations. One Magazine sued the Post Office, arguing the magazines should be protected under the 1st Amendment as free speech.
The Supreme Court ruled 9-0 in favor of One, Inc., finding the content of the magazine not obscene. The Court held One Magazine can't be considered obscene simply because it contains homosexual content.
