Dred Scott- enslaved African American who had lived for almost five years with his owner, an army surgeon, in the free state of Illinois and in Wisconsin Territory, both places where the 1820 Missouri Compromise prohibited slavery. Scott argued that residence in a free state and territory made him free. opposed by Buchanan

taney- said that African Americans couldn't be us citizens and couldn't sue in federal courts (despite free African Americans in many northern states), said that Conress couldn't prevent southern citizens from moving slave property into the territories, said Northwest Ordinance and Missouri Compromise that prohibited slavery had never been constitutional and Congress couldn't prohibit slavery (endorsing popular sovereignty)
effect: republicans accused taney and Buchanan of conspiracy
Buchanan made that worse by trying to admit Kansas as a slave state after teh Lecompton constitution despite the fact that Kansas was mostly anti-slavery. Dem/architect of kansas-nebraska act Stephen Douglas broke with the president and wanted congress to deny kansas statehood. Buchanan also tried to buy Cuba in 1858, which also further split his party and the nation
