The Unassigned Lands was land taken from the Creek and Seminole tribes in Indian Territory that was not assigned to anyone. This drew the attention of non-Indian settlers that soon turned into a demand that the Unassigned Lands be opened to the public. These settlers justified their demands by arguing that the Unassigned Lands applied to the Homestead Act that allowed Americans to file a claim to 160 acres of public land.
