Following the decision of the Court of Appeals in Drumgo v. Marin Superior Court, which held that the court had a- bused its discretion in failing to appoint an attorney requested by the defendant (for details, see article on that decision, this issue) Judge Wilson decided he would accept the motions of the two previously appointed attorneys, relieving them of their appointments and appointing Marvin and Skip. As both of these attorneys have had considerable experience in the criminal field, and have shown a unique ability to establish close personal rapport with the Brothers, this is considered to be a major victory in their struggle to achieve the type of defense necessary to fight the serious charges.
The attorneys were appointed at a hearing on July 24th. The judge also authorized each of the attorneys to employ an investigator at the expense of the State. In addition, at this same hearing the judge ruled that the Brothers should appear in court with only restraints placed around their waists.
However, the hearing took place in a specially prepared courtroom, from which the first row of spectator seats had been removed, and which had two special seats riveted to the floor for the defendants, to which their waist restraints were attached. Further hearings are to take place on September 11, at which Marvin and Skip will again move to have the Brothers appear with no shackles or other compromise restraints, such as special courtrooms.
Also argued will be a motion to quash the indictments on the grounds that the selection process for Grand Jurors was unconstitutional, and a motion for a restricted change of venue, to move the trial out of Marin County, to another county which would have a more representative proportion of minority residents.
Finally, since the previous motion to suppress evidence was won, the District Attorney obtained a search warrant and got the same evidence again, so a further motion to suppress evidence will be heard. The trial has been set for October 24th and further details as to the development of this important case will be reported in future issues of the Conspiracy.
