The Horne v. Flores case was a class action lawsuit that took place in the state of Arizona. The LEP students in Arizona charged that schools were not adequately funding language support programs and thus, violating LEP students' rights under the Equal Educational Opportunity Act of 1974. The state of Arizona appealed the lower courts decisions because the state made the following changes to ESL education: providing more funding, LEP students started receiving four hours of sheltered instruction per day, and NCLB was put into effect. This appeal was elevated to the Supreme Court. The Supreme Court gave the following guidance to the district court: that funding isn't the only consideration regarding EEOA, following NCLB doesn't mean that LEP students' civil rights are being met, and that Structured English Immersion programs are preferable to bilingual education programs. The lower court in Arizona still has not ruled in this case. However, if the court does rule in favor of Arizona's sheltered instruction program, then other states may follow suit which would essentially isolate ELLs from their English speaking peers.
