February – A three-judge panel of the 10th U. S. Circuit Court of Appeals in Denver overturned Judge Rodgers’ decision and reinstated the State’s first lawsuit, ruling that the tribe was not an essential party to the action since the Interior Department represented its interests. It also ruled that Secretary Babbit had overstepped his authority in declaring the tracts to be a reservation and allow gambling. (WNK2)
