25 giug 2007 anni - Morse v. Frederick
Descrizione:
High school student Joseph Frederick held up a banner that said "Bong Hits 4 Jesus" during a school-sponsored event. The principal, Deborah Morse took away the banner and Frederick was suspended for ten days for promoting illegal drug use. He sued for violation of his First Amendment rights, and the case slowly made its way up to the Supreme Court. The Supreme Court ruled 5-4 in favor of Morse, ruling that though students have some right to political speech at school, school officials can stop students from promoting illegal drug use.
This case is the closest to the present and further proves that though peaceful, not distracting political protests are allowed in schools, the promotion of things that are against school policy are not. This further cements the idea that though students are protected by the First Amendment, there are exceptions and prohibiting illegal or inappropriate speech is completely allowed. Drug use among teens was a problem at the time (and still is) and that is part of the reason that the court held this decision and the case went up all the way to the Supreme Court.
