13 gen 1988 anni - Hazelwood School District v. Kuhlmeier

Descrizione:

The school newspaper for Hazelwood East High School sent the pages proofs to the principal, Robert E. Reynolds. He deemed two of the articles inappropriate and ordered them to be withheld from the final publication. Cathy Kuhlmeier and two other former Hazelwood East students took the case to court, accusing it of violating their First Amendment rights. In a 5-3 decision, the court ruled that the First Amendment didn't protect editorial decisions made by the school to keep speech consistent with "the shared values of a civilized social order."

This case added to the idea that though students are allowed to have free speech, some things that may be against school policy aren't protected. The principal or school board has the right to edit what things are said or written in a school newspaper as it is more of a representation of the school and less a representation of the student who wrote it. This helped strengthen the idea of what free speech in schools looks like in editorial decisions.
