Jamie Shupe (born 1963) is a retired United States Army soldier who, in 2016, became the first person in the United States to have their sex legally declared as non-binary. The Portland, Oregon court ruling in the Multnomah County Courthouse by Amy Holmes Hehn is described as the first of its kind in the U.S. by the Transgender Law Center and Lambda Legal.

Born male, Shupe previously changed his sex to female in 2013 while identifying as a transgender woman and successfully battled the Army to change his name and gender on military records. But unsatisfied with the female designation, he initiated the court case, setting a historic legal precedent.

The judge did not question Shupe during the brief hearing, and he attended the legal proceeding with two doctor's letters, one from Oregon Health & Science University (OHSU) and the other from The Department of Veterans Affairs, stating he was neither male or female.

Six months after Shupe's court ruling, the demand for 3rd gender designations soared. Media reports credit them for inspiring many of the successful petitioners

By August 2017, more than 250 Oregon residents had chosen "X" as their identification choice, and by November 2017 the number had reached 720.
