Descrizione:

A Supreme Court case determining the federal government's supreme power within its jurisdiction. The Elastic Clause of the Constitution, stating that "The Congress shall have Power ... To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof," was a source of much contention between the two parties. The clause would go on to be used as justification for many an act by the federal government, such as the creation of a National Bank. In 1819, Maryland tried to impede the Bank by taxing it. The Marshall Supreme Court struck down this tax, ruling that the Elastic Clause implied the power for the federal government to create a National Bank.
