In 1898, a black man named James Brown was found guilty of murder. Brown was tried and sentenced where he only received five peremptory challenges. Under a normal jury, he would have received twenty peremptory challenges. Brown sent a petition to the Supreme Court as an unequal protection and violates the 14th Amendment. Brown was voted down however as the Supreme Court said that it did not violate the 14th Amendment.
