Critics of Senate Report 310 argued terminating the federal-tribal relationship would give the gov a liability escape hatch from its failures to protect tribal lands/fulfill treaty obligations. ICC formed to settle outstanding Indigenous suits against the federal gov, after which jurisdiction over Native lands could cleanly transfer to the states. Without authority to modify land title, ICC usually settled claims with cash payments. ICC created a precedent for Indigenous activists to testify against termination policy in Congress through the 1950s.
