Succession of the south created a republican majority in both houses of congress. Within republican ranks there were sharp differences between the radical fraction who wanted immediate abolition of slavery and the moderate fraction who were more focused on opportunities for whites. Most democrats supported the war but criticized lincoln's conduct of it.
Copperhead- Copperheads were those who opposed the war and wanted to negotiate for peace. Congressman Clement of Ohio was the most notorious copperhead. He was briefly banished from the U.S. to the confederacy for his treasonable acts which were speeches against the war. He fled to canada. He represents and spoke for the advocates of peace in America.
Ex parte milligan- After the war the supreme court ruled that the government had acted wrong in indiana where during the war citizens were subjected to military trials. The supreme court declared that such procedures could only be used when regular civilian courts were unavailable.
The draft- Those who volunteered for the war fought. Both the Union and confederacy resorted to drafting their citizens into service. Union passed an act that made all males from the ages of 20-45 eligible to serve. They allowed a draftee to avoid the war with a 300$ exemption fee or finding a substitute to serve. Riots would soon break out in protest of the draft.
