Citizens Advice Newcastle plays a vital role in addressing issues of national importance by sending evidence of local cases to National Citizens Advice, local MPs, and sometimes the media. This action helps raise awareness and advocate for change. This evidence supports lobbying efforts aimed at prompting the government, statutory agencies, and others to implement appropriate changes.
A recent success story is the introduction of the Tenancy Deposit Protection Scheme, which became law in April 2007. This achievement, resulting from the combined efforts of Citizens Advice Newcastle and other local offices nationwide over the past ten years, ensures the protection of tenant deposits during tenancies and facilitates the speedy resolution of disputes without court involvement. The scheme offers two options: a custodial arrangement where an independent third party holds the deposit during the tenancy, and an insured option where the landlord retains the deposit, committing to repay any agreed amount to the tenant at the tenancy's end.
The legislation mandates specific timeframes within which landlords must place deposits into a scheme and provide tenants with details. Landlords who fail to comply will lose the right to take possession action, and tenants can seek a court order to enforce compliance and impose a financial penalty on the landlord equivalent to three times the deposit's value.
This marked a historic day for Citizens Advice's campaigning work, but the final hurdle was to make sure tenants were aware of their new rights. So, Citizens Advice Newcastle embarked upon a new community awareness campaign, including making a presentation to a Regional Landlords Association Conference and highlighting the new responsibilities of landlords; contributing to interviews on local radio and providing press releases to regional newspapers; and also, in recognition that there are large numbers of students who will be affected by this new legislation in Newcastle, a meeting was held with the student accommodation departments at The University of Northumbria and Newcastle University to ensure that all new students would be given information on the new scheme.
