The client attended Citizens Advice Newcastle with her carer, as she is elderly and in ill health. She had received letters from Lowell Financial, a debt collection agency, demanding £500.
Her carer called to find out what the debt was for and was informed that it was a Provident debt from 2007. The client sought advice on what actions she could take. She stated that she was not aware of this debt and had certainly not acknowledged it in recent years. It appeared that the debt might be unenforceable under the Statute of Limitations Act. Citizens Advice Newcastle wrote to Lowell Financial requesting evidence that the client had acknowledged the debt within the last 6 years. Lowell Financial responded, stating that they would no longer be pursuing the debt and that no further action would be taken.
