Flores v. State of Arizona was filed in the federal district court. The parents of children enrolled in the Nogales Unified School District (NUSD). It was alleged by plaintiffs that the civil rights of Limited English Proficient (LEP) students were infringe because the state failed to provide a program of instruction that included academic instructional programs, adequate language acquisition and funding for at-risk, low-income, minority students . It was alleged that public schools district allowed students to exit LEP programs and enter mainstream classrooms when those students still lacked necessary reading comprehension skills and English language. This greatly increases the impediment for Latino and other language minority students for their education. This is a wonderful asset for the English learner program. The Equal Educational Opportunity Act has set the standard of taking appropriate action to overcome language barriers in a English learner program.
