12 dic 2021 año - Current Day Claim and summary of each case: To what extent are Americans enjoying the rights we were granted by the Constitution?

Descripción:

Claim: In the current day Americans do enjoy some of the rights they were granted in the Constitution, but many rights have to be changed based on the adaptation of Society.

1st Amendment: Americans are enjoying their 1st Amendment rights. Both examples show the 1st Amendment still impacting the world today. In the Snyder vs Phelps case, although the words were very harmful the Westboro Baptist Church was in a public area and has the right to freedom of speech and freedom to assemble from the constitution. In the Ahlquist vs Cranson case, some may say that the 1st Amendment is being violated because a piece of religion is being censored, butin reality it as the opposite. The whole idea of the First Amendment is to not force religion onto people and taking down the sign helps secure that idea along with Jeffersons' Wall between Church and everyday life.

2nd Amendment: Americans are somewhat enjoying the rights of the 2nd Amendment but some of the original rights are gone. This is because society has become more modern and awareness of the dangers of guns is higher. In both Heller vs District of Columbia and the current day article, The Supreme Court was trying to bring back rights from the 2nd Amendment. This shows that the Amendments have been altered, but this also shows that the Amendment is still valued and still impacts the world today.

4th Amendment: Americans are somewhat enjoying the rights of the 4th Amendment. In the TLO example, it shows that students' 4th Amendment Rights still apply at school but because of probable cause and the teachers' authority they can be taken away very easily. The Facebook Whistle-blower argument shows that Social Media companies could be violating peoples 4th Amendment rights by knowing too much information about its users. Both of these cases show that the 4th Amendment is changing and being slowly taken away by companies.

5th Amendment: Americans are enjoying their 5th Amendment rights in the current day. After their Miranda case the Supreme court made sure people are enjoying these rights by making it mandatory to tell criminals they have the right to remain silent. In the White v Woodall case, many will think his 5th Amendment rights are violated but it wasn't because he gave up too much dangerous information that the court couldn't ignore.

Throughout all of these examples, most of Americans rights are intact but a few are being changed as society becomes more modern
