Shank sued the US government for arresting him for spreading anti-war pamphlets limiting under the Espionage and Sedition Acts. Argued that it was a violation of his constitutional rights. Supreme court ruled that free speech was not unlimited, like screaming fire in a crowded theater. Cannot create "clear and present danger."
